SW TI DRC undertakes to take all necessary measures to ensure that the processing of personal data complies with the Law of July 30, 2018 relating to the protection of individuals with regard to the processing of personal data (hereinafter the \u201c<strong>Law<\/strong>\u201d) and with the European Regulation of April 26, 2016 relating to the protection of natural persons with regard to the processing of personal data and the free movement of such data (hereinafter the \u201c<strong>Regulation<\/strong>\u201d).<\/p><p>SW TI DRC is free to choose any natural or legal person who processes Users\u2019 personal data at its request and on its behalf (hereinafter the \u201c<strong>Processor<\/strong>\u201d). Where applicable, SW TI DRC undertakes to select a Processor providing sufficient guarantees regarding the technical and organizational security measures for processing personal data, in accordance with the Law and the Regulation.<\/p><h2>2. Processing of Personal Data<\/h2><p>The use of the Website by Users may result in the communication of personal data. The processing of such data by SW TI DRC, in its capacity as Data Controller, or by service providers acting in the name and on behalf of SW TI DRC, shall comply with the Law and the Regulation.<\/p><p>Personal data shall be processed by SW TI DRC, in accordance with the purposes set out below, through:<\/p><p>An automated procedure;<br \/>The use of cookies.<\/p><h2>3. Purpose of the Processing of Personal Data<\/h2><p>In accordance with Article 13 of the Regulation, the purposes of the processing of personal data are communicated to the User and are as follows:<\/p><p>Ensure the performance of the services offered and agreed upon on the Website;<br \/>Ensure the monitoring of the execution of the services offered;<br \/>Carry out marketing activities and promotional communications after the User\u2019s prior consent and until such consent is withdrawn, for example by sending promotions regarding the Data Controller\u2019s products and services;<br \/>Respond to the User\u2019s questions;<br \/>Produce statistics in order to improve the Website, the services offered, and the internal organization;<br \/>Improve the quality of the Website and of the products and\/or services offered by the Data Controller;<br \/>Enable a better identification of the User\u2019s areas of interest.<\/p><h2>4. Personal Data Likely to Be Processed<\/h2><p>When visiting and using the Website, the User consents to SW TI DRC collecting and processing, in accordance with the methods and principles described in this Privacy Policy, the following personal data:<\/p><p>Information provided by Users for contractual purposes and to ensure the proper performance of reciprocal obligations, namely surname, first name, address, etc.; and more generally, any information voluntarily provided by the User;<br \/>Information provided by Users when filling in forms or contacting SW TI DRC by phone, email, or any other means, such as the User\u2019s name, address, email address, and telephone number;<br \/>Regarding each visit by Users to the Website, the following information is automatically collected:<br \/>a. IP address, browser type and model, time zone, operating system;<br \/>b. All information relating to the pages viewed by the User on the Website, including the URL and browsing time.<\/p><h2>5. Consent<\/h2><p>By accessing and using the Website, the User declares that they have read and freely, specifically, knowingly, and unambiguously agreed to the processing of their personal data. This agreement concerns the content of this Privacy Policy.<\/p><p>Consent is given through the positive act by which the User ticks the box referring to the Privacy Policy via a hyperlink. This consent is an essential condition for carrying out certain operations on the Website or for enabling the User to enter into a contractual relationship with SW TI DRC. Any contract binding SW TI DRC and a User concerning the services and goods offered on the Website is subject to the User\u2019s acceptance of the Privacy Policy.<\/p><p>The User consents to the Data Controller processing and collecting, in accordance with the methods and principles included in this Privacy Policy, the personal data that the User communicates on the Website or in connection with the services offered by SW TI DRC, for the purposes indicated above.<\/p><p>The User has the right to withdraw their consent at any time. Withdrawal of consent shall not affect the lawfulness of processing based on consent previously given.<\/p><h2>6. Retention Period for Users\u2019 Personal Data<\/h2><p>In accordance with Article 13 \u00a72 of the Regulation and the Law, the Data Controller shall retain personal data only for the period reasonably necessary to achieve the purposes for which they are processed.<\/p><p>In all cases, this period shall be less than: 24 months, unless a longer period is required to comply with legal, accounting, or tax obligations, or to respond to disputes.<\/p><h2>7. Recipients of Data and Disclosure to Third Parties<\/h2><p>Personal data may be transmitted to SW TI DRC employees, collaborators, subcontractors, or suppliers who provide adequate guarantees regarding data security and who cooperate with SW TI DRC in the marketing of products or provision of services. They act under the direct authority of SW TI DRC and are notably responsible for collecting, processing, or subcontracting such data.<\/p><p>In all cases, the recipients of the data and those to whom the data have been disclosed shall comply with the content of this Privacy Policy. SW TI DRC ensures that they will process such data solely for the intended purposes, in a discreet and secure manner.<\/p><p>Should the data be disclosed to third parties for direct marketing or prospecting purposes, the User shall be informed in advance so that they may express their consent to the use of their personal data.<\/p><h2>8. Users\u2019 Rights<\/h2><p>At any time, the User may exercise their rights by sending an email to the following address: <a href=\"mailto:info@cd.sw.pro\">info@cd.sw.pro<\/a> or by sending a letter by post, together with a copy of their identity card, to the following address: No. 8, Avenue Kundelungu, Golf District, Commune and City of Lubumbashi, Haut-Katanga Province, Democratic Republic of the Congo.<\/p><h3>a. Right of access<\/h3><p>In accordance with Article 15 of the Regulation, SW TI DRC guarantees the User the right to access their personal data. The User has the right to obtain access to said personal data as well as the following information:<\/p><ul><li>the purposes of the processing;<\/li><li>the categories of personal data concerned;<\/li><li>the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients established in third countries or international organizations;<\/li><li>where possible, the envisaged retention period for the personal data or, where not possible, the criteria used to determine that period;<\/li><li>the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the Regulation and, at least in such cases, meaningful information about the underlying logic, as well as the significance and expected consequences of such processing for the data subject.<\/li><\/ul><p>The Data Controller may charge reasonable administrative costs for any additional copies requested by the User.<\/p><p>Where the User submits the request electronically (for example via email), the information shall be provided in a commonly used electronic format, unless the User requests otherwise.<\/p><p>A copy of the data shall be communicated to the User no later than one month after receipt of the request.<\/p><h3>b. Right to rectification<\/h3><p>SW TI DRC guarantees the User the right to rectify and erase personal data.<\/p><p>In accordance with Article 16 of the Regulation, inaccurate, incomplete, or irrelevant data may be corrected or erased at any time. The User shall first make the necessary changes themselves through their user account\/other means, unless such changes cannot be made independently, in which case the request may be made to SW TI DRC.<\/p><p>In accordance with Article 19 of the Regulation, the Data Controller shall notify each recipient to whom the personal data have been disclosed of any rectification of personal data, unless such communication proves impossible or involves disproportionate effort. The Data Controller shall provide the data subject with information about those recipients if requested.<\/p><h3>c. Right to erasure<\/h3><p>The User has the right to obtain the erasure of their personal data as soon as possible in the cases listed in Article 17 of the Regulation.<\/p><p>Where the Data Controller has made the personal data public and is obliged to erase them pursuant to the previous paragraph, the Data Controller, taking into account available technology and implementation costs, shall take reasonable steps, including technical measures, to inform other controllers processing such personal data that the data subject has requested the erasure by such controllers of any links to, or copy or replication of, those personal data.<\/p><p>The two previous paragraphs shall not apply to the extent that processing is necessary:<\/p><ul><li>for exercising the right of freedom of expression and information;<\/li><li>for compliance with a legal obligation requiring processing under Union law or the law of the Member State to which the controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;<\/li><li>for the establishment, exercise, or defence of legal claims.<\/li><\/ul><p>In accordance with Article 19 of the Regulation, the Data Controller shall notify each recipient to whom the personal data have been disclosed of any erasure of personal data or restriction of processing carried out, unless such communication proves impossible or involves disproportionate effort. The Data Controller shall provide the data subject with information about those recipients if requested.<\/p><h3>d. Right to restriction of processing<\/h3><p>The User has the right to obtain restriction of processing of their personal data in the cases listed in Article 19 of the Regulation.<\/p><p>In accordance with Article 19 of the Regulation, the Data Controller shall notify each recipient to whom the personal data have been disclosed of any restriction of processing carried out, unless such communication proves impossible or involves disproportionate effort. The Data Controller shall provide the data subject with information about those recipients if requested.<\/p><h3>e. Right to data portability<\/h3><p>In accordance with Article 20 of the Regulation, Users have the right to receive from SW TI DRC the personal data concerning them in a structured, commonly used, and machine-readable format. Users have the right to transmit those data to another controller without hindrance from SW TI DRC in the cases provided for by the Regulation.<\/p><p>Where the User exercises their right to data portability pursuant to the previous paragraph, they have the right to have the personal data transmitted directly from one controller to another, where technically feasible.<\/p><p>The exercise of the right to data portability shall be without prejudice to the right to erasure. This right shall not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.<\/p><p>The right to data portability shall not adversely affect the rights and freedoms of others.<\/p><h3>f. Right to object and automated individual decision-making<\/h3><p>The User has the right at any time to object to the processing of their personal data on grounds relating to their particular situation, including automated data processing carried out by SW TI DRC. In accordance with Article 21 of the Regulation, SW TI DRC shall no longer process the personal data unless there are compelling legitimate grounds for the processing which override the interests and rights and freedoms of the User, or for the establishment, exercise, or defence of legal claims.<\/p><p>Where personal data are processed for direct marketing purposes, the User has the right to object at any time to the processing of personal data concerning them for such marketing purposes, including profiling insofar as it is related to such direct marketing.<\/p><p>Where the data subject objects to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.<\/p><h3>g. Right to lodge a complaint<\/h3><p>The User has the right to lodge a complaint regarding the processing of their personal data by SW TI DRC with ARPTC (Regulatory Authority for Posts and Telecommunications of the Congo), the competent authority in the Congolese territory. Cookies<\/h2><p>The Website uses cookies to distinguish Users of the Website. This enables Users to enjoy a better browsing experience and allows improvements to the Website and its content. The purposes and methods relating to cookies are set out in this article.<\/p><h3>a. General principles<\/h3><p>A \u201cCookie\u201d is a file temporarily or permanently placed on the User\u2019s hard drive when consulting the Website for the purpose of a subsequent connection. Security<\/h2><p>The Data Controller implements organizational and technical measures to ensure a level of security appropriate to the processing and collection of data. These security measures depend on the implementation costs in relation to the nature, context, and purposes of the processing of personal data.<\/p><p>The Data Controller uses standard encryption technologies within the IT sector during the transfer or collection of data on the Website.<\/p><h2>12. Modification of the Privacy Policy<\/h2><p>SW TI DRC reserves the right to modify this Privacy Policy in order to comply with applicable legal obligations. Users are therefore invited to regularly consult the Privacy Policy in order to stay informed of any modifications and adaptations.
